A regular meeting of the Town Board of Grand Island, New York was held at the Town Hall, 2255 Baseline Rd., Grand Island, NY at 8:00p.m. on the 1st of December, 2008.

Supervisor Peter McMahon called the meeting to order at 8:00p.m.

Reverend Gerald Haberstro from Harbor Lights Fellowship gave the Invocation. 

Councilwoman Susan Argy led the Pledge of Allegiance.

A public hearing was held at 8:00 P.M. for the purpose of hearing anyone who wanted to make comments in favor or in opposition to proposed Final Plat Approval for Golf Course Villas at River Oaks – Phase 3 (21 Lots).

Acceptance of Public Improvements for Waterford Park Subdivision – Phase I

A motion was made by Councilman Crawford, seconded by Councilman Roesch to adopt the following resolution in the matter of the laying out of certain town highways in the Town of Grand Island County of Erie and State of New York to be known as part of Waterford Park and Stony Point Road:

 

Upon submission of the annexed deed of dedication of Isle Landings, LLC, dedicating and releasing the necessary lands for proposed town highways as set forth in the annexed legal description in the Town of Grand Island, County of Erie, State of New York, to be known as part of Waterford Park and Stony Point Road; now therefore, it is

 

            RESOLVED that, in accordance with the provisions of Section 171 of the Highway Law of the State of New York, consent is given that the Highway Superintendent of the Town of Grand Island make an Order accepting and laying out the aforesaid town highways to be known as part of Waterford Park and Stony Point Road, the Town highways to consist of the lands described in the deed of dedication, subject to the approvals of the Town Engineer, Highway Superintendent, and the attorneys for the Town, and it is further

 

            RESOLVED that, subject to the approvals of the Town Engineer and the attorneys for the Town and the Order of the Highway Superintendent laying out the aforesaid town highways to be known as Waterford Park and Stony Point Road, the Town Board hereby accepts the annexed deed of dedication, provided it is filed by the attorney for Isle Landings, LLC, or his representative, in the Erie County Clerk’s office and the attorneys for the Town are provided with a certified copy thereof documenting such satisfactory filing.

Acceptance of Public Improvements for Waterford Park Subdivision – Phase I

A motion was made by Councilwoman Cooke, seconded by Councilwoman Argy to adopt the following resolution in the matter of the Acceptance and Laying Out of certain Town Highways in the Town of Grand Island County of Erie and State of New York to be known as part of Waterford Park and Stony Point Road

              WHEREAS, Isle Landings, LLC, has offered for dedication lands for proposed town highways to be known as part of Waterford Park and Stony Point Road; and

 

            WHEREAS, the plans submitted by Isle Landings, LLC in connection with such proposed town highways include turnaround, storm drainage, and sanitary sewer easements in favor of the Town of Grand Island; and

 

            WHEREAS, Isle Landings, LLC, has offered such turnaround, storm drainage, and sanitary sewer easements to the Town of Grand Island;

 

NOW, THEREFORE, BE IT RESOLVED, subject to the approvals of the Town Engineer, Highway Superintendent, and the attorneys for the Town, the Town Board does hereby accept from Isle Landings, LLC, the owner of Waterford Park Subdivision, Temporary Storm Drainage and Turnaround Easements as shown by the plans submitted to the Town, provided the easements are filed by the attorney for Isle Landings, LLC, or his representative, in the Erie County Clerk’s office and the attorneys for the Town are provided with a certified copy thereof documenting such satisfactory filing;

 

AND BE IT FURTHER RESOLVED, that subject to the approvals of the Town Engineer, Highway Superintendent, and the attorneys for the Town, the Town Board does hereby accept from Isle Landings, LLC, the owner of Waterford Park Subdivision, the Permanent Sanitary Sewer and Storm Drainage Easements as shown by the plans submitted to the Town, provided the easements are filed by the attorney for Isle Landings, LLC, or his representative, in the Erie County Clerk’s office and the attorneys for the Town are provided with a certified copy thereof documenting such satisfactory filing.

 

AND BE IT FURTHER RESOLVED, that, subject to the approval of the attorneys for the Town, the Supervisor is authorized and directed to execute said easements.

A motion was made by Councilman Crawford, seconded by Councilwoman Cooke to accept the recommendation of the Town Engineer and authorize the Supervisor to sign a Professional Services Agreement for the Water Treatment Plant Tube Settlers and Waterline Replacement upon review and approval of the Town Attorney.

Public Improvement Permit – Whitehaven Road Campground

A motion was made by Councilwoman Cooke, seconded by Councilman Argy to accept the recommendation of the Town Engineer and approve the Public Improvement Permit for Whitehaven Road Campground for constructing the potable water distribution system.

Award Bid – Wastewater Treatment Plant Polymer

Town Engineer John Whitney reported that the bids were opened on November 19, 2008 for the purchase of polymer for phosphorous removal at the Grand Island Wastewater Plant.  Two bids were received from the following:

 

CleanWaters, Inc.                            $ 0.975 / pound

 

SNF Polydyne                                            $ 1.10 / pound

 

After careful review of the bids, Mr. Whitney recommended the low bidder, CleanWaters, Inc. be awarded the bid in the amount of $ 0.975 / pound.

A motion was made by Councilwoman Argy, seconded by Councilwoman Cooke to accept Mr. Whitney’s request for low bidder CleanWaters, Inc. to be awarded the bid for the purchase of polymer for phosphorous removal at the Grand Island Wastewater Plant in the amount of $0.975/ pound.

RECREATION DIRECTOR – LINDA TUFILLARO:
