A regular meeting of the Town Board of Grand Island, New York was held at the Town Hall, 2255 Baseline Rd., Grand Island, NY at 8:00p.m. on the 17th of September 2007.

Supervisor Peter McMahon called the meeting to order at 8:00p.m.

Reverend David Rodgers from Emmanuel Community Bible Church gave the Invocation.

A public hearing was held at 8:00 P.M. for purpose of hearing anyone who wanted to speak in favor of or in opposition to Final Plat Approval for Ash Brooke Court Estates – Phase I.

A public hearing was held at 8:00 P.M. for purpose of hearing anyone who wanted to speak in favor of or in opposition to Local Law Intro #8 of 2007 to possibly adopt revisions to Article 5 of the Town Code of the Town of Grand Island regarding the composition of and matters to be considered by the Architectural Review Board.

Erie County Board of Elections – Polling Location Lease Agreement – Town of Grand Island Properties

A motion was made by Councilwoman Cooke, seconded by Councilman Roesch to authorize the Supervisor to sign a lease subject to permissive referendum to the extent required by law to use Town properties for the upcoming 2007 Primary and General election.  The Town will receive $300 each day for the use of Town Hall, Nike Base, Highway Garage and the Library.

Change Order No. 1 – Bituminous Resurfacing of Various Town Roads – Job No. M-14-2007

A motion was made by Councilwoman Cooke, seconded by Councilwoman Argy to approve Change Order No. 1 for bituminous resurfacing of various town roads – Job No. M-14-2007 at a net increase to the contract of $4,200.57.  The funds are available in the Highway Budget.

Request to Re-divide Adjacent Parcels – 2116 & 2126 Harvey Road

A motion was made by Councilman Roesch, seconded by Councilwoman Argy to approve the request to transfer a portion of lot 2116 to lot 2126 Harvey Road.  The request is to remove 70’ frontage from #2116, attach to #2126.  The resulting frontage at #2116 will be 80’ (decreased from 150’) and 2126 will become 145’ (increased from 70’).  The request is approved subject to proof satisfactory to the Town Attorney that all required paperwork is filed with the Erie County Clerk.

RECREATION DIRECTOR – LINDA TUFILLARO:

Unfinished Playing Field at Veterans Park

Recreation Director Linda Tufillaro reported that she received bids for the scope of work to be completed at Veterans Park for the soccer/football practice area.  Three bids were received from the following:

Double D                                              $5,900.00 (includes $1,400 due from prev. work)

LDC Construction                           $17,850.00

Grand Island Greatscape                $4,300.00

After careful review of the bids, Ms. Tufillaro recommended the low bidder, Grand Island Greatscape be awarded the bid in the amount of $4,300.00.

A motion was made by Councilman Roesch, seconded by Councilwoman Argy to award the bid work to be completed at Veterans Park for the soccer/football practice area to Grand Island Greatscape in the amount of $4,300.00.

PLANNING BOARD:

New England Estates – Preliminary Plat – Revision 5

A motion was made by Councilwoman Cooke, seconded by Councilman Roesch to accept the recommendation of the Planning Board and grant Preliminary Plat for New England Estates – Revision 5.  Two additional lots have been eliminated and 7 Ύ additional acres of property will be conveyed to the Town for open space. The Planning Board has referred this to the Conservation Commission and Recreation Advisory Board.

Richard O. Robinson/LPJ Development – Abandon Interest in Paper Streets (a portion of 6th Street, 2nd, and 3rd Avenues and Merge Lots)

A motion was made by Councilman Roesch, seconded by Councilwoman Cooke to accept the recommendation of the Planning Board and abandon interest in paper streets on portions of 6th Street, Second and Third Avenues subject to proof satisfactory to the Town Attorney that all required paperwork is filed with the Erie County Clerk.

Fairview Court – Request  to Install Street Lights and Final Pavement

A motion was made by Councilwoman Cooke, seconded by Councilman Roesch to refer the request from residents of the Fairview neighborhood for installation of street lights and final pavement to the Assessor’s office to verify that the signatures qualify for the establishment of a lighting district and the Highway Superintendent for review.

A motion was made by Councilman Roesch, seconded by Councilwoman Cooke to authorize the Code Enforcement Officer to issue building permits for the Senior Apartments at Town Hall Terrace with the condition that no Certificate of Occupancy be issued until the final site drainage is approved by the Town Engineer.
